Terms of service
These terms set out the agreement between you and the company behind Feetz & Co. when you use this website or buy from it. We have written them in plain language, because terms nobody reads protect nobody. Where a clause limits what we are responsible for, we say so in ordinary words rather than burying it in capital letters.
Please read section 21 in particular, which explains the limits of our liability, and section 25, which sets out the rights the law gives you in your own country. Nothing in these terms takes those rights away.
By browsing this website or placing an order, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the site.
1. Who you are contracting with
This store is operated by Nevara Group LLC, a limited liability company registered in the State of Wyoming, United States, trading as Feetz & Co. In these terms, "we", "us" and "our" mean Nevara Group LLC, and "you" means the person using the site or placing the order.
When you buy something here, your contract of sale is with Nevara Group LLC and with nobody else. Our full company details are on our Legal Notice page.
These terms should be read together with our Return and Refund Policy, our Shipping Policy and our Privacy Policy, which form part of the agreement between us. If anything in those documents conflicts with these terms, the more specific document wins for the subject it covers, and any interpretation more favourable to you as a consumer prevails over one less favourable.
2. Who may buy from us
To place an order you must be at least 18 years old, or the age of majority where you live if that is higher, and legally able to enter into a contract. If you allow someone in your household who is under that age to use this site on a device you control, you are responsible for what they do with it.
Our products are sold for your own personal or household use. You may not buy from us for commercial resale, and we may decline or cancel orders that appear to be placed for resale, including unusually large or repeated orders of the same item.
3. Your account and the details you give us
You can order as a guest or create an account. Either way, please make sure the information you give us is accurate and current, particularly your email address and delivery address. Most delivery problems trace back to a mistyped address, and once a parcel has been dispatched it cannot be redirected.
If you create an account, keep your login details to yourself. You are responsible for activity that takes place under your account. Tell us straight away if you think someone else has access to it. You may not sell, transfer or share your account with anyone.
4. How an order becomes a contract
Placing an order is an offer to buy. It is accepted, and a contract formed, when we send you a dispatch confirmation email, not when you pay and not when you receive the automatic order confirmation. Payment is taken at checkout; if we do not accept your order, we refund it in full.
We may decline an order, or part of one, where an item is out of stock, where there is an obvious error in the price or description, where we cannot verify the payment or delivery details, where we cannot ship to your address, or where we reasonably believe the order is for resale or is fraudulent. If we decline or change an order we will contact you using the email address, phone number or billing address you gave us, and refund anything you have paid.
The language of the contract is English. Please keep your order confirmation; we do not file a separate copy of the contract in a form you can access later.
5. Our products, materials and photographs
All Feetz & Co. jewelry is gold-plated or silver-plated stainless steel. Our pieces are finished by hand, so small variations between individual items are normal. Measurements are given to the nearest millimetre and may vary slightly.
We photograph our products under studio lighting and edit as little as possible. Even so, colour and finish can look different on your screen depending on your device and its settings, and a small variation in shade between the photograph and the item you receive is not a defect.
Plating. Plating is a surface layer, and on any plated jewelry it wears thin over time. Water, sweat, perfume, sunscreen and cleaning products all speed this up, and jewelry worn on the foot meets more friction than jewelry worn on the wrist. Gradual fading through normal wear is a characteristic of the material rather than a fault. Plating that flakes, blisters or discolours within days of first wear is a different matter and we treat it as a defect: see section 11 and our jewelry care guide.
Materials and sensitivity. We choose stainless steel because most people tolerate it well, but no metal suits everyone. If you know you react to a particular metal, please check the material listed on the product page before ordering. If an item causes a reaction because it is not made of the material we described, that is a fault and we will refund you in full. An unworn item can of course be returned in the usual way.
We may change product descriptions, discontinue a product, or limit the quantity available to any person or region at any time. This does not affect orders we have already accepted.
6. Prices, currency and taxes
Prices are shown in the currency you select and include any sales tax or VAT we are required to charge, which is confirmed at checkout before you pay. Shipping is shown separately. The price that applies is the one displayed when you place your order, as set out in your order confirmation.
Prices, discounts and promotions can change at any time, but a change never affects an order we have already accepted.
Prices do not include import duties, tariffs or customs handling fees charged by the country your parcel is delivered to. Those are set by your government and, where they apply, are payable by the recipient. Our Shipping Policy explains what to expect in each country we ship to.
7. Promotions, discount codes and free gifts
Unless we say otherwise, one discount code applies per order and codes cannot be combined. Codes have no cash value, cannot be exchanged for cash, and may be withdrawn or expire. Where a promotion has its own terms, those terms apply to that promotion.
We may cancel an order and void a code where a code has clearly been used in a way it was not intended for, such as codes shared publicly that were issued to an individual, or repeated use of a first-order code across multiple accounts.
If you return items bought in a promotion, our Return and Refund Policy explains how the discount and any free gift are handled. In short: you keep the benefit of the promotion on whatever you keep.
8. Payment
Payments are handled by Shopify Payments and by the wallet and card providers shown at checkout. We do not see or store your full card number.
By paying, you confirm that you are authorised to use the payment method and that the details you have given are correct. If a payment is reversed or fails after dispatch, we may ask you to pay by another method or to return the goods.
If you believe a charge is wrong, please contact us before raising a dispute with your bank. Almost every payment problem is resolved faster by email than by chargeback, and we would rather sort it out with you directly.
9. Delivery and risk
We ship to the United States, the United Kingdom, Canada, Australia and New Zealand. Delivery times given on the site and at checkout are estimates based on what we actually see, not guarantees, and customs clearance is the largest variable.
Risk passes to you when the goods are delivered, meaning when you or someone you have nominated takes physical possession of them. Until that moment, a parcel that is lost or damaged in transit is our responsibility, not yours, and we will replace it or refund you as set out in our Shipping Policy. You do not have to claim from the carrier yourself.
If we cannot dispatch within the time stated on the site, we will contact you with a revised date and you may either wait or cancel for a full refund.
10. Cancelling, returning and refunds
You can cancel an order at any time before it is dispatched by emailing us with your order number; if the parcel has not gone, we cancel and refund in full.
After delivery, you have 30 days to request a return under our Return and Refund Policy, which explains what condition items must be in, who pays return postage and how quickly refunds are issued. Customers in the United Kingdom also have a statutory right to cancel within 14 days of delivery, which applies alongside our 30-day policy and is described in section 25.
Because our jewelry is worn against the skin, items that have been worn beyond a try-on cannot be returned for reasons of hygiene. Trying an item on to check the fit never affects your right to return it.
11. Faulty, damaged or incorrect items
If something arrives faulty, damaged or not as ordered, contact us with a photograph and we will replace it or refund you in full, including all shipping costs. You will not be asked to pay to return a faulty item.
Beyond the 30-day return window we cover manufacturing defects for 12 months from delivery, including clasps that fail in normal use, links or settings that come apart, and stones that fall from their setting without impact. This commitment is in addition to your statutory rights and does not replace them. It does not cover normal wear, accidental damage, plating that fades over time, or items that have been altered, resized or repaired elsewhere.
12. Mistakes on the website
Despite our best efforts, a page may occasionally show an incorrect price, description, delivery estimate or availability. We may correct such errors at any time and, where an order was placed on the basis of an obvious error, cancel it and refund you in full before dispatch. We will always contact you first, and we will not use this clause to undo a deal simply because it turned out to be unprofitable.
13. Acceptable use of this website
You may use this site for lawful purposes only. In particular, you may not use it to break any law; to infringe our intellectual property or anyone else's; to harass, threaten, defame or abuse our staff or other people; to post false or misleading information; to send spam or unsolicited advertising; to impersonate another person; to upload malicious code; or to attempt to gain unauthorised access to the site, its servers or other users' data.
You may not scrape, copy or systematically extract our product data, photography or copy, or use the site's content to train a machine learning model, without our written permission.
14. Automated access and agents
An "agent" means software that acts autonomously or semi-autonomously on behalf of a person, including AI shopping assistants and browsing agents. Agents may use this site only if they identify themselves as an agent and give the name of the agent, do not disguise the fact that a request comes from an agent, answer truthfully when asked whether they are human, and do not attempt to bypass measures that block or limit automated access. We may restrict agent access by technical means.
15. Reviews, feedback and anything you send us
If you send us a review, photograph, suggestion or other content, you keep ownership of it and you give us permission to use, reproduce, adapt and publish it in connection with our business, including in marketing, without payment. We may publish reviews with your first name and last initial. Tell us if you would rather we did not use something, and we will take it down.
You confirm that content you send is your own, that it does not infringe anyone's rights, and that you have disclosed any product, discount or payment you received in exchange for it. We may decline to publish, or remove, content that is unlawful, abusive, misleading or unrelated to the product.
16. Intellectual property
The Feetz & Co. name and logo, our product photography, page copy, graphics and the design and arrangement of this site are owned by Nevara Group LLC or used under licence and are protected by copyright and trademark law.
You may view, download and print pages for your own personal use. You may not reproduce our photography or copy commercially, resell our content, or use our name, logo or images in a way that suggests an association with or endorsement by Feetz & Co. without our written permission.
Third-party names and trademarks that may appear on this site remain the property of their owners, and their appearance does not imply any affiliation or endorsement. If you believe something on this site infringes your rights, section 6 of our Legal Notice explains how to tell us.
17. Third-party tools and links
This site uses tools and services provided by third parties, and links to third-party websites and social media. We do not control them and we are not responsible for their content, availability or practices. Using an optional third-party tool is at your discretion and subject to that provider's own terms. Following an external link means leaving feetzdesigns.com.
18. Our relationship with Shopify
This store runs on the Shopify platform. Any purchase you make is made directly with Nevara Group LLC, and Shopify is not a party to it and is not responsible for any aspect of a sale between you and us, including any loss or damage arising from the products. You release Shopify and its affiliates from claims arising from your transactions with us. Nothing in this section affects our own responsibilities to you, or your statutory rights.
19. Privacy
Personal information collected through this site is handled as described in our Privacy Policy. Because the site is hosted by Shopify, Shopify also processes information about your visit in order to run and improve the platform.
20. Availability of the website
We aim to keep the site available but we do not guarantee uninterrupted access. We may suspend, withdraw or restrict all or part of the site for maintenance, security or business reasons, and we may end your access if you have seriously or repeatedly breached section 13. Suspension of the site does not affect any order we have already accepted, which we will still fulfil or refund.
21. What we are and are not responsible for
We are responsible for loss you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care. Loss is foreseeable if it is obvious that it will happen, or if it was clear to both of us when the contract was made that it might.
We are not responsible for loss that is not foreseeable, for business losses such as lost profit, lost revenue or lost opportunity, since we supply to consumers for personal use, or for delays and failures caused by events outside our reasonable control as described in section 23.
Except where a statutory guarantee applies, the site and its content are provided as they are, and we do not promise that the site will always be error-free, uninterrupted or free of harmful components.
Where our liability can lawfully be limited, our total liability to you in connection with any order will not exceed the greater of the amount you paid for that order and 100 USD.
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for defective products under applicable product liability law, or for anything else that cannot lawfully be limited. In particular, nothing here limits rights that cannot be excluded under the UK Consumer Rights Act 2015, the Australian Consumer Law, the New Zealand Consumer Guarantees Act 1993, Canadian provincial consumer protection legislation, or applicable United States federal and state consumer law.
22. Your responsibility to us
If you break these terms and a third party brings a claim against us as a direct result, you agree to cover the reasonable losses and legal costs we incur because of it. This applies only to claims caused by your own deliberate or negligent breach, and not to anything arising from our own acts, omissions or breach.
23. Events outside our control
We are not responsible for delays or failures caused by events beyond our reasonable control, including customs authorities, carrier disruption, industrial action, extreme weather, natural disasters, war, epidemics, failures of public networks or acts of government. If such an event affects your order, we will contact you as soon as we can. Where a delay is substantial, you may cancel and receive a full refund for anything not yet delivered.
24. Complaints and disputes
If something has gone wrong, email hello@feetzdesigns.com with your order number. We acknowledge complaints within one business day and aim to give a final answer within ten business days. If you are not satisfied with the answer, reply and ask for it to be reviewed and a different person will look at it. Section 9 of our Legal Notice lists the consumer bodies you can approach in your country if we cannot resolve it between us.
25. Your statutory rights
These terms are our commercial agreement with you. They sit on top of the rights the law gives you, and where the two differ, whichever is better for you applies.
United Kingdom
The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 give you the right to cancel your order for any reason from the moment you place it until 14 days after the day you receive the goods, with a further 14 days to send them back. Where you cancel under those Regulations we refund the price of the goods plus the standard outbound delivery charge, within 14 days of the goods reaching us; you pay the cost of returning them. The Consumer Rights Act 2015 additionally gives you a 30-day right to reject goods that are faulty, not as described or not fit for purpose, and rights to repair, replacement or a price reduction after that.
Australia
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage, and to have goods repaired or replaced if they are not of acceptable quality and the failure is not major.
New Zealand
Where you buy as a consumer, the Consumer Guarantees Act 1993 gives guarantees of acceptable quality, fitness for purpose and correspondence with description that cannot be contracted out of, and the Fair Trading Act 1986 applies to how we describe and advertise our products.
Canada
Provincial and territorial consumer protection legislation gives you rights in addition to these terms, including implied warranties of merchantable quality. In Quebec, the Consumer Protection Act gives further rights in respect of distance contracts.
United States
Your state may give you rights in addition to these terms, and the Federal Trade Commission's Mail, Internet or Telephone Order Merchandise Rule entitles you to cancel and be refunded if we cannot ship within the time we promised.
26. Changes to these terms
We may update these terms from time to time, for example to reflect changes in the law or in how we operate. The version published on this page when you place an order is the version that governs that order; later changes do not apply retroactively to orders already placed. The date at the foot of this page shows when it was last revised.
27. General
If any part of these terms is found to be unenforceable, the rest continues to apply. If we do not insist that you do something you are required to do, or delay in taking action, that does not mean we have given up our rights. You may not transfer your rights or obligations under these terms without our written consent; we may transfer ours, for example if our business is sold, provided this does not reduce your rights. Together with the policies referred to in section 1, these terms are the whole agreement between us about your use of this site and your purchases from it.
28. Governing law
These terms and any contract of sale made through this site are governed by the laws of the State of Wyoming, United States, and the courts of that state have jurisdiction.
If you are a consumer, this does not deprive you of the protection of the mandatory consumer law of the country where you live, and you may bring proceedings in your local courts. Where your national consumer law gives you stronger rights than these terms, those rights apply.
